This Privacy Policy describes how Kelexia LLC ("Kelexia," "we," "our," or "us") collects, uses, shares, and protects information when you visit our website, use our platform, or interact with our AI-powered call booking services. By using our Services, you consent to the data practices described in this Policy.


1. Information We Collect

1.1 Information You Provide Directly

  • Account Information: Name, email address, phone number, company name, job title, and password when you register
  • Billing Information: Payment card details, billing address, and transaction history (processed securely via our payment processor)
  • Lead Data: Contact information of leads you import or generate through the platform (names, phone numbers, email addresses, property preferences)
  • Communications: Messages, support tickets, and any correspondence you send us

1.2 Information Collected Automatically

  • Usage Data: Pages viewed, features used, clicks, time spent, and platform interactions
  • Device & Technical Data: IP address, browser type and version, operating system, device identifiers, and referring URL
  • Log Data: Server logs, error logs, and performance data
  • Cookies & Tracking: Cookies, pixel tags, and similar technologies as described in our Cookie Policy

1.3 Information from Third Parties

  • Lead data from integrated platforms (Zillow, Realtor.com, GoHighLevel, etc.)
  • Calendar and scheduling data from Calendly or similar integrations
  • CRM data synced from HubSpot, Salesforce, Follow Up Boss, or LionDesk
  • Call and SMS logs from Twilio or other telephony providers

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, maintain, and improve our Services
  • Process payments and manage subscriptions
  • Power our AI call booking, lead qualification, and appointment scheduling features
  • Send transactional emails, service notifications, and important account updates
  • Send marketing communications (only with your consent; you may opt out at any time)
  • Respond to your inquiries and provide customer support
  • Monitor and analyze usage patterns to improve user experience
  • Detect, prevent, and investigate fraud, abuse, and security incidents
  • Comply with applicable legal obligations

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following circumstances:

3.1 Service Providers

We share data with trusted third-party vendors who assist us in providing the Services, including cloud hosting providers, payment processors, telephony providers (Twilio), email service providers, and analytics tools. These providers are contractually obligated to use your data only for the purposes we specify.

3.2 Integrations

When you connect third-party integrations (e.g., Calendly, HubSpot, Mercury), data is shared with those platforms in accordance with your instructions and those platforms' own privacy policies.

3.3 Mercury Banking

If you open a Mercury business account through our referral, information relevant to the account opening process is shared with Mercury Financial LLC. Mercury's collection and use of your information is governed by Mercury's Privacy Policy. Kelexia is not responsible for Mercury's data practices.

3.4 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

3.5 Legal Requirements

We may disclose information if required by law, court order, or governmental authority, or if we believe disclosure is necessary to protect the rights, property, or safety of Kelexia, our users, or the public.

4. Data Retention

We retain your personal information for as long as your account is active or as needed to provide Services. After account deletion, we may retain certain data for up to 3 years for legal compliance, audit purposes, and fraud prevention, unless applicable law requires a different retention period. Lead data you import is retained until you delete it or your account is terminated.

5. Data Security

Kelexia implements industry-standard security measures to protect your information, including:

  • AES-256 encryption for data at rest
  • TLS 1.2+ encryption for data in transit
  • Multi-factor authentication (MFA) for account access
  • Regular penetration testing and vulnerability assessments
  • Role-based access controls (RBAC) for internal data access
  • SOC 2 Type II compliance (in progress)

Despite these measures, no internet transmission or electronic storage is 100% secure. We encourage you to use strong passwords and enable MFA on your account.

6. Your Privacy Rights

Depending on your location, you may have the following rights under applicable privacy law (including CCPA, GDPR, and others):

  • Right to Access: Request a copy of the personal data we hold about you
  • Right to Correction: Request correction of inaccurate or incomplete data
  • Right to Deletion: Request deletion of your personal data (subject to legal exceptions)
  • Right to Portability: Receive your data in a structured, machine-readable format
  • Right to Opt Out: Opt out of marketing communications at any time
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights

8. Children's Privacy

Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us immediately at contact@kelexia.com.

9. International Data Transfers

Kelexia is based in the United States. If you access our Services from outside the US, your information may be transferred to, stored, and processed in the US or other countries. By using our Services, you consent to such transfers. Where required by law, we use Standard Contractual Clauses or other appropriate safeguards for international transfers.

10. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA). You may request to know the categories and specific pieces of personal information we have collected, request deletion, and opt out of the "sale" of personal information. Our Services may contain links to third-party websites and services. Kelexia is not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

We may update this Privacy Policy periodically. We will notify you of significant changes via email or a prominent notice on our platform. Your continued use of the Services after any changes constitutes your acceptance of the updated Privacy Policy.
